Terms of Service

These Terms of Service ("Terms") govern your use of the Loomika mobile application ("Loomika", "the app", "we", "our", or "us"). By downloading, installing, or using Loomika, you agree to be bound by these Terms. If you do not agree, please do not use the app.

1. Acceptance of Terms

By accessing or using Loomika, you confirm that you accept these Terms and agree to comply with them. We may update these Terms from time to time, and continued use of the app after changes take effect constitutes acceptance of the updated Terms.

2. Age Requirements

Loomika can be used at any age. However, certain features are age-restricted:

• Creating an account and using Cloud Sync requires you to be at least 13 years old
• Cloud-based AI features require you to be at least 13 years old

The app asks for your year of birth on first launch to apply these restrictions. If you are a parent or guardian and believe your child has misrepresented their age, please contact us.

3. Description of Service

Loomika is a flashcard learning application that uses the FSRS (Free Spaced Repetition Scheduler) algorithm to help you study and retain information. Your decks, cards, and study progress are stored locally on your device, as described in our Privacy Policy.

4. AI Features

Loomika offers features that generate flashcards, translations, and example sentences using artificial intelligence (Google Gemini or an on-device model). You acknowledge that:

• AI-generated content is produced automatically and may be inaccurate, incomplete, or misleading
• We do not guarantee the correctness of AI-generated content; please review it before relying on it for studying
• You are responsible for the prompts you submit and for reviewing generated content before use
• Content generated in the app is marked as AI-generated at the point of creation

5. Subscriptions & In-App Purchases

Loomika may offer optional subscriptions or in-app purchases to unlock additional features. These purchases are processed through the Apple App Store or Google Play Store and managed via RevenueCat.

• Prices and available features may change; we will make reasonable efforts to notify you of material changes
• Statutory withdrawal rights for digital content are handled through the respective app store at the time of purchase

6. Advertising

We may display advertisements through Google AdMob to support the free version of the app. In the European Economic Area, ads are only processed in accordance with your consent choices, which you can change at any time in the app's settings. See our Privacy Policy for details.

7. User Content

You retain full ownership of the decks, cards, and other content you create in Loomika. This content is stored locally on your device and is never accessed by us unless you explicitly export or share it, or upload it via Cloud Sync for the purpose of providing the sync service.

8. Acceptable Use

When using Loomika, you agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or otherwise extract the source code of the app, except where permitted by law
• Interfere with or disrupt the app's functionality or security features
• Upload or create content that is illegal, infringing, or harmful to others
• Use AI features to generate content that is illegal or harmful

9. Intellectual Property

The Loomika app, including its design, branding, logo, and underlying code, is our property and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of the app to you. Content you create within the app remains your own, as described above.

10. Disclaimer of Warranty

Loomika is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the app will be uninterrupted, error-free, or that using it will result in any particular learning outcome. This does not affect warranties that cannot be excluded under applicable consumer protection law.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of, or inability to use, Loomika, including loss of data stored locally on your device. Nothing in these Terms limits our liability for intent, gross negligence, injury to life, body, or health, or under mandatory statutory liability provisions.

12. Termination

We may restrict or terminate your access to the app if you violate these Terms. You may stop using Loomika at any time by uninstalling the app from your device.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the revised Terms on this page and updating the "Last updated" date.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Germany. If you are a consumer residing in the European Union, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence, and statutory rules on jurisdiction for consumer disputes remain unaffected.
